Terms of Service (ToS) for ModBase

1. Service Description & Scope

ModBase provides backend moderation infrastructure primarily for Roblox communities, including:

• Moderation linking between Discord and the Game
• Viewing game statistics and in-game logs (e.g., admin actions like car spawns).
• API endpoints for automatic or manual input of logs, including Webhook Logging features.

Usage Limits:

Users are limited to approximately 10,000 API logs per day. Requests for free increases can be submitted via support channels.

Pricing:

Currently, all services are provided free of charge.

2. User Eligibility

• Users must be at least 13 years of age, in line with Discord's minimum age requirements.
• By using this service, you represent and warrant that you meet the minimum age requirement and are legally permitted to use Discord in your country of residence.
• Use of the service is prohibited where restricted by law.
• We reserve the right to suspend or terminate accounts that provide false information or fail to meet eligibility requirements.

3. User Accounts & Security

• Account creation is handled automatically via Discord OAuth2 authentication.
• Users are responsible for maintaining the security of their Discord accounts.
• Our system employs device metadata checks to prevent unauthorized access even if session tokens or cookies are compromised.
• Accounts may be suspended or terminated for API abuse, spamming endpoints, or illegal activities.

4. User Content

• Users may upload profile images representing their games or servers.
• All user-generated content remains the intellectual property of the user.
• Users are fully responsible for ensuring their content complies with applicable laws.
• Uploading illegal or inappropriate content may result in immediate termination and ban.

5. Acceptable Use Policy

You agree not to:

• Abuse or spam the API.
• Engage in illegal, fraudulent, or harmful activities.
• Attempt to hack or compromise the Services or other users' accounts.

Consequences for violations:

• First offenses: Warning issued.
• Two warnings: Account termination (restricted access remains for data export or account deletion).
• Appeals can be submitted at support@modbase.dev.

6. Intellectual Property

• All ModBase software, dashboard components, and logos are the intellectual property of ModBase.
• Third-party components such as Tremor retain their respective IP rights.
• Users may utilize the Service as permitted but may not copy or redistribute ModBase IP except for allowed third-party components under their licenses.

7. Disclaimers & Liability

• The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.
• ModBase makes no guarantees regarding uptime, availability, performance, or the accuracy of results generated through the Service.
• We are not liable for interruptions, errors, data loss, or unauthorized access resulting from user actions, including but not limited to mismanagement of API keys or account credentials.
• Users are solely responsible for maintaining the security of their API keys, tokens, and account information.
• ModBase is not responsible for any loss of data caused by compromised credentials or misuse of the Service. If you experience data issues, you may contact us at support@modbase.dev, and we will make reasonable efforts to assist, but no guarantee of recovery is provided.

8. Termination

• Users or ModBase may terminate service usage at any time.
• Upon termination, users lose access to Services except for data export or account deletion functionality.
• Data retention and deletion procedures are governed by the Privacy Policy.

9. Governing Law & Jurisdiction

• These Terms are governed by German and European Union law.
• Any disputes arising shall be subject to the exclusive jurisdiction of German courts.

10. Modifications to Terms

• ModBase reserves the right to update or modify these Terms at any time, at its sole discretion.
• We will make reasonable efforts to notify users of material changes through our Notification System or other appropriate channels.
• Any changes take effect upon posting, unless otherwise stated. Continued use of the Services after such changes constitutes your acceptance of the updated Terms.
